Welcome to White Pearl Spa, located at 2037 Indian River Blvd, Vero Beach, FL 32960. By opting in to receive SMS communications, booking appointments, purchasing services, enrolling in memberships, or using our website or services, you agree to these Terms & Conditions. These terms comply with all applicable federal and Florida laws, including the Florida Telephone Solicitation Act (§ 501.059), automatic renewal provisions (§ 501.165), retail refund signage requirements (§ 501.142), and gift certificate rules (§ 501.95).

1. SMS Program Description

By providing your mobile phone number and expressly opting in (via website, booking forms, payment pages, advertisements, SMS keywords, or in-spa registration), you consent to receive SMS/text messages from White Pearl Spa. Messages may include:

- Appointment confirmations, reminders, and scheduling updates  

- Service-related notifications and customer care messages  

- Promotional offers, discounts, and new service announcements (**marketing/solicitation messages** require prior express written consent)  

- Follow-up communications  

Message frequency varies based on your interactions. Consent to receive SMS is not a condition of purchase.  

By opting in, you confirm that you are the authorized user of the mobile number provided, that the information submitted is accurate and complete, and you authorize White Pearl Spa to send text messages using automated technology to that number.

We strive to comply with the Florida Telephone Solicitation Act (FTSA), Fla. Stat. § 501.059. “Telephonic sales call” includes text messages for soliciting sales of consumer goods or services. Marketing texts using an automated system require prior express written consent. All texts are sent only between 8:00 AM and 8:00 PM in the recipient’s time zone.

2. Opt-Out Instructions

Reply STOP to any message to opt out of SMS communications. You will receive a confirmation message. Pursuant to Fla. Stat. § 501.059(10)(c), we will cease sending text message solicitations within 15 days after receipt of your STOP request and may not send further marketing texts thereafter (except a one-time confirmation of receipt).

3. Message & Data Rates; Carrier Disclaimer

Message and data rates may apply according to your wireless carrier plan. Contact your carrier for details. Wireless carriers are not liable for any delayed, failed, or undelivered messages.

4. Appointment Booking & Reservation Terms

We offer Pay Now and Pay After reservations. By booking an appointment, you agree to the following:

- Only one reschedule is generally permitted per reservation.  

- Reschedule or cancellation requests must be submitted at least 24 hours before the scheduled appointment time.  

- Late cancellations (less than 24 hours’ notice), no-shows, or missed appointments may result in forfeiture of any deposit, prepaid amount, promotional rate, or reservation slot, and may result in refusal of future bookings or promotions.  

- Promotional pricing is valid for first-time guests only unless otherwise stated.  

- Appointment availability is limited and subject to confirmation.

These policies protect scheduled service time and are clearly disclosed during the booking process.

5. No Refunds & No Exchanges Policy

ALL SALES ARE FINAL. NO REFUNDS. NO EXCHANGES.  

This policy applies to all purchases, including services, treatment sessions, packages, prepaid services, promotional offers, deposits, reservation fees, memberships, retail products, and gift certificates.  

Unused services, missed appointments, partially used programs, or unused benefits have no cash value and are non-transferable, except where Florida law expressly requires otherwise.

Retail Goods (Fla. Stat. § 501.142): A “No Refund / No Exchange” sign is posted at the point of sale. Failure to post such a sign would create a presumed refund policy: a refund (within 7 days of purchase) for unused merchandise in its original carton upon proof of purchase. Exemptions include food, perishables, custom-made or custom-altered goods, and items prohibited from resale. We comply fully with signage and disclosure requirements.

Gift Certificates (Fla. Stat. § 501.95): Gift certificates sold or issued for monetary consideration in Florida may not have an expiration date or period and may not incur any post-sale charge or fee (including service, dormancy, account maintenance, or cash-out fees). Exceptions: (1) charitable contributions (expiration ≥3 years if disclosed), (2) employee-incentive or certain loyalty/promotional programs (expiration ≥1 year if no separate charge and disclosed), or (3) event-tied packages where the majority of value is attributable to the limited-duration event. We fully comply.

6. Membership Billing & Recurring Charges (Automatic Renewals)

By enrolling in a membership or recurring service, you authorize recurring charges to your payment method on file according to the terms presented at signup. All recurring charges are final once processed.

Fla. Stat. § 501.165 (Automatic Renewal of Service Contracts): Automatic renewal provisions are disclosed clear and conspicuously. For qualifying contracts, we provide written or electronic notice 30–60 days before the cancellation deadline where required. Cancellations must be requested before the next billing date. Previously processed charges and partial billing periods are non-refundable.

7. No Guarantee of Results

Individual treatment results vary from person to person. White Pearl Spa does not guarantee specific aesthetic, skincare, wellness, or treatment outcomes. Any testimonials, before-and-after images, or service descriptions are for informational and promotional purposes only and do not constitute guarantees.

8. Medical Disclaimer

Services provided by White Pearl Spa are cosmetic and wellness-focused in nature and are not intended to diagnose, treat, cure, or prevent any medical condition or disease. Clients should consult with a licensed physician regarding any medical concerns, conditions, contraindications, allergies, sensitivities, or health-related questions before receiving services.

19. Limitation of Liability

To the maximum extent permitted by law, White Pearl Spa, its owners, employees, contractors, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the use of our services, appointments, memberships, SMS communications, or website.

10. Chargebacks & Payment Disputes

By completing a purchase or booking, you agree not to improperly dispute valid charges with your bank or credit card provider. You agree to contact White Pearl Spa directly first to resolve any billing concerns. White Pearl Spa reserves the right to provide booking records, signed forms, SMS confirmations, payment authorizations, IP logs, appointment history, and communications to financial institutions or dispute processors in response to any chargeback claims.

11. Eligibility

You must be at least 18 years old (the age of majority in Florida) to opt in to SMS, book appointments, purchase services, or enroll in memberships.

12. Privacy Policy

Your personal information is handled in accordance with our Privacy Policy, available on our website or upon request. We do not sell your personal information.

13. Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any disputes, claims, or controversies arising out of or relating to these Terms, purchases, services, memberships, appointments, or SMS communications shall be venued exclusively in the Circuit Court of the Nineteenth Judicial Circuit in and for Indian River County, Florida. The parties irrevocably submit to the jurisdiction of such court and waive any defense of inconvenient forum.

We reserve the right to modify these Terms at any time. Updated versions will be posted on our website with the revised effective date. Your continued use after changes constitutes acceptance.
